Cláudia Monge speaks at the Judicial Protection of Health as a Fundamental Right seminar

The Centre for Judicial Studies (CEJ) will host the meeting promoted by the European Judicial Training Network (EJTN) entitled Judicial Protection of Health as a Fundamental Right, which will present an overview of the European legal framework.

Cláudia Monge, lawyer and Assistant Professor at FDUL and Visiting Assistant Professor at the Faculty of Medicine of the University of Lisbon, will speak on 14 December with two lectures on “Health as a fundamental right: a European Union law perspective” and “The right to healthcare and the European Court of Human Rights jurisprudence”.

The speakers at this meeting will address aspects such as health and healthcare in the Charter of Fundamental Rights of the European Union, the right to healthcare and the European Court of Human Rights, the principle of effectiveness and complementarity between health and consumer protection, health data and the regime under the GDPR, health and non-discrimination based on illness, obesity, temporary incapacity, conflict between health and other fundamental rights.

It will be an event to exchange knowledge and best practices between experts and EU peers, applying the European legal framework and case law to practical cases. The participants – judges, public prosecutors, and court clerks – will have the opportunity to analyze the right to health protection, the legal effects of its provision as a fundamental and human right, and the duties of the state.
